  • What do family lawyers do?

    Family lawyers specialise in legal matters pertaining to family life. Their areas of expertise might include:

  • Is it better to have a lawyer for a divorce?

    Divorcing without the help of a lawyer is certainly possible. However, it's usually only feasible in the most straightforward divorce cases.


    If you're a young couple, have no children and agree on the particulars of your separation, then a "DIY divorce" could be worth pursuing.


    If, however, there's any room for disagreement, then it might be more sensible to use a lawyer. Things that are likely to cause problems include financial issues, child custody disputes and housing arrangements.


    Even if you plan to go down the DIY route, it's worth having your paperwork checked by a qualified family divorce lawyer. They can check if everything is correct and help you avoid major pitfalls, all for a reasonable, one-off fee.

  • What are the legal requirements for divorce?

    For many years, you couldn't obtain a divorce without proving that your spouse was at fault – or that you had lived apart for a number of years.


    The legal definition of "fault" was quite narrow. It referred to one of three things: adultery, desertion or unreasonable behaviour.


    This all changed in April 2022. Now you don't have to prove fault – you only have to state that your marriage has irretrievably broken down.


    The legislation that effected this change is called the "The Divorce, Dissolution and Separation Act 2020", though it's more popularly known as "no-fault divorce".

  • What is divorce mediation?

    Divorce mediation seeks to resolve issues and disagreements surrounding a separation without involving the court system.


    You can think of it as a guided discussion, overseen by a neutral divorce mediator. Mediators don't offer legal advice or make decisions – they're there to help you come to a fair agreement with your spouse.


    Mediation is a popular option for divorcing couples as it's often faster, cheaper and less stressful than taking the divorce to court. In most cases, you'll have to prove you've at least considered mediation to be allowed to progress to court.
