May 2008 - Second Chance given a Second Chance thanks to funds raised at exclusive DVD launch

Second chanceAs part of Brain Injury Awareness Week, local charity Second Chance Headway with the support of Milners Solicitors, hosted an exclusive luncheon on Friday 4th April to mark the official launch of their DVD.  This informative DVD has been produced to help educate people on dangerous driving and how brain injury can affect lives. 

The event was held at Waterton Park’s La Terrazza Restaurant and sponsored by long established Leeds firm Milners Solicitors.  Hosted by Gaynor Barnes, who announced her patronage to the charity on the day, the event was a huge success resulting in over £4,000 being raised.  Due to the current redevelopment plans of Pinderfields Hospital the location of Second Chance has become threatened; these funds are essential to help Second Chance improve their facilities and expand into new premises.  The event was attended by key personalities from the surrounding area such as former rugby league player and patron of the charity Neil Fox. 

Sponsors of the event, Milners Solicitors who have been established in Leeds since 1897, have recently opened their first high street office on Wood Street in Wakefield and are enjoying being a part of the Wakefield community.  Simon Bass, Managing Partner of Milners comments “it was a pleasure to sponsor this DVD launch, we feel Second Chance is a very worthwhile charity helping people affected by brain injury rebuild their lives.”

January 2008 - Ask the Personal Injury Expert

This month is the turn of our Personal Injury Department and Partner Helen Beaumont answers an example of a frequently asked question:

 Q  I slipped on some spilt tea whilst descending the stairs at work and badly damaged my ankle.  I have to take four weeks sick leave and risk losing my bonus.  Am I entitled to compensation?

A  If your accident occurred within the last 3 years you will be able to claim compensation from your employers for failing to provide you with a safe place of work.

The amount you will recover for your injuries largely depends upon your period of suffering and whether or not you are expected to make a full recovery.  If you have not already seen your general practitioner or attended hospital you should make an appointment as soon as possible.  It is likely that you will require medical advice.  You need to ensure that you tell the doctor exactly how the accident occurred and the injuries you sustained.

It is often helpful to keep a diary of how your injuries progress.  You should record how you feel each day and how your injuries impact upon your ability to work and day to day living.

You will be entitled to recover your loss of earnings for your period of absence from work and loss of bonus.  In addition you will be able to recover out of pocket expenses, for example taxi fares, prescription charges and additional care and assistance provided by family and friends.  You need to keep documentation to prove these losses and retain any damaged items.

Your accident should be recorded in your employer’s accident book.  You should read through the entry before signing it to ensure that it accurately reflects the circumstances of your accident and the injuries you sustained.

Sadly one of our founding partners Mr Patrick Milner has died at the age of 66.

The practice was originally founded by his grandfather who was the Leeds Coroner.

We pass on our deepest sympathies to his wife and family from all the staff at Milners.

27 November 2007 - Application for Paralegal/Training Contract 2008

We are looking to appoint two LPC students as paralegals to commence work in August 2008. The successful recruits will commence employment as paralegals and after a period, if selected, will be invited to join us as Trainee Solicitors.

Milners is a niche 5 Partner Commercial firm operating out of modern city centre offices. May 2007 - Home Improvement Packs – an update

On 22nd May the Government again delayed the implementation of the Home Information Pack (HIP) – this was following representations from Solicitors, The Royal Institute of Chartered Surveyors (RICS) and Estate Agents that the proposed packs were expensive and unnecessary.

The decision followed the threat of a legal challenge questioning the validity of the consultation process prior to implementation of HIP’s which had been planned to be introduced on 1 June.

The Government now proposes that HIP’s will be introduced on 1st August but will only apply to properties with four bedrooms.  For other properties there is a proposal to introduce HIP’s over a period of time.

There have been many delays to the introduction of HIP’s but here at Milners we are ready to implement the packs irrespective of when and if the government actually give the go-ahead.

We would advise that before you even consider marketing your property you contact our residential conveyancing specialist Martin Gaffney for a free informal chat.  We can also advise on and check any estate agent contracts before you sign and instruct them to act for you.  This could save you up to 1% of the sale costs of your property, which on a sale price of £200,000.00 could be as much as £2,000.00.

April 2007 - Conveyancing - Home Information Packs (HIPs) the new legal requirement for selling your home

Our property specialist Martin Gaffney answers questions in a regular feature in the Leeds Guide publication. In a recent issue he was asked about the new Home Information Packs:

QUESTION - Are these HIPs going to cause me problems or make things better? I’m planning on selling my place in the city before the end of the year but don’t want any more problems than usual.

ANSWER - Under the Housing Act 2004 from June 1 it will be a legal requirement that you have a Home Information Pack (HIP) in place and ready for inspection by potential buyers and their Conveyancers.

The HIP comprises two parts, one compulsory, containing:

  • Index
  • Sale Statement
  • Title Documents
  • Local Authority Search
  • Water Search
  • Energy Performance Certificate (EPC)

And one non- compulsory containing:

  • Home Condition Report (HPR)
  • Home use form Sellers Property Information Form / Leasehold Form
  • Fixtures and Fittings Form
  • Searches such as Mining, Environmental and and searches peculiar to the area
  • Summary Statement covering key issues

Apart from the EPC and the non-compulsory HCR the information can be easily put together by your conveyancer and indeed is really no different than the sale packs provided for sale at auction.

As for the EPC this can be obtained by the seller or with the assistance of the conveyancer who should be able to recommend a Home Inspector.

Beware of some HIP Providers that will be marketing their products after the 1 June. Many will be new to the property market and early indications point to costs of between £300 to £500 plus estate agency fees of 1 to 1.5%
Some will even try to get you to sign up for a credit agreement just to cover the costs of the pack!

The costs of the HIP will be reduced if you contact your solicitor before you appoint an estate agent. At the end of the day a seller’s conveyancer will know exactly what a buyer's conveyancer requires.
